1. Does the Regulatory Reform (Fire Safety) Order 2005 (RRFSO) apply to my business or organisation?

The answer is quite probably yes! The RRFSO applies to virtually all premises and covers most types of buildings, structures and open spaces where people are employed or people gather together, such as:

  • Offices and shops.
  • Factories and warehouses.
  • Premises that provide sleeping accommodation.
  • Hotels and hostels.
  • Residential care premises.
  • Educational premises, universities, colleges and schools.
  • Places of public assembly.
  • Theatres, cinemas and similar premises.
  • Open air events and venues.
  • Healthcare premises.
  • Transport premises and facilities.
  • Animal premises and stables.
  • Community halls and premises.
  • Places of worship.
  • Shared areas of premises that several households live in.
  • Public houses, restaurants, cafes and clubs.
  • Sports arenas.
  • Tents and marquees.

There are certain other premises that are covered by their own primary legislation and are therefore not affected by the RRFSO. Such premises include; offshore installations, ships, aircraft, trains, road vehicles, mines, quarries and boreholes.

The RRFSO does not apply to private single dwellings or individual flats in a block of flats or house.

2. Whose responsibility is it to make my business premises compliant?

The Regulatory Reform (Fire Safety) Order 2005 defines the responsible person as the person who has control of the building and is one of the following:

  • In any workplace, the employer, if the workplace is under his/her control.
  • In relation to any premises that is not a workplace, the person who has control of the premises in connection with the carrying out of a trade (e.g. occupier).
  • In relation to any premises that is not a workplace, the owner, where the person in control of the premises does not have control in connection with the carrying on of a trade, business or other undertaking in that premises.

3. What records have to be kept following the Fire Risk Assessment?

The responsible person must keep written records of all arrangements under the Regulatory Reform (Fire Safety) Order 2005 where:

  • 5 or more persons are employed.
  • A licence for use of the premises is in force.
  • An Alterations Notice issued under the Regulatory Reform (Fire Safety) Order 2005 has been made requiring records to be kept.

4. I don't have the time, the staff or confidence to carry out a fire safety risk assessment, what can I do?

The responsible person must appoint a person with sufficient training, experience and knowledge to assist in undertaking preventative and protective measures. The Regulatory Reform (Fire Safety) Order 2005 recognises that a lot of small and medium sized organisations don’t have the time, resources or expertise to carry out risk assessments. This means that you can employ an external professional, such as Safety Assessment Solutions , who is competent to carry out the risk assessment.

Our fire risk assessor has 30 years experience in the Fire and Rescue Service with responsibilities for fire safety assessment and enforcement. He is a Bachelor of Science and a Corporate Member of the Institution of Fire Engineers. He is also qualified to NEBOSH (National Examination Board in Occupational Safety and Health) Fire Risk Assessment and Management standards.

9. How will Safety Assessment Solutions work with me during the Fire Risk Assessment?

After an initial free consultation where we will discuss your needs, you will be free to decide whether to engage our services. Should you wish to do so, we will visit your premises to discuss and carry out a thorough examination of the fire risks present, together with any relevant documentation and the control measures already in place. We will assess their effectiveness and make relevant recommendations and develop an action plan in conjunction with you. We pride ourselves on our ability to achieve cost effective solutions to meet the requirements of the Regulatory Reform (Fire Safety) Order 2005. 12. What training can be provided by Safety Assessment Solutions?

All training is approved by the Fire Protection Association and provides successful delegates with a certificate, valid for 3 years, upon passing a short multiple choice test.

13. What approvals and quality assurances are given with staff training?

All training is to standards approved and certificated by the Fire Protection Association.

14. What happens after the Fire Risk Assessment has been completed?

You will receive a comprehensive user friendly report including; the risk assessment documents, detailed analysis, executive summary, recommendations and a prioritised action plan. We will include photographs where relevant to bring more clarity to the report. You will then receive ongoing support as necessary during the implementation of the action plan.

16. Do I need a Fire Risk Assessment every year?

The Regulatory Reform (Fire Safety) Order 2005 requires that Fire Risk Assessments are reviewed on a regular basis. The time interval will vary, dependent on the nature of the risks and the control measures in place and can vary from daily (very high risk) to annually (low risk). Reviews of the Fire Risk Assessment are also required when there is reason to suspect that it is no longer valid or where there has been significant change in the matters to which it relates such as;

  • Changes in processes or procedures.
  • Changes in personnel.
  • New responsibilities for personnel.
  • The introduction of new substances.
  • New legislation introduced.
  • After a fire incident or near miss.

Usually, changes occur gradually over a longer period of time and it is therefore good practice to review the Fire Risk Assessment on at least an annual basis.

18. If I need to make alterations to my premises following the Fire Risk Assessment, what support is available?

We will provide expert guidance during the planning and implementation of any alterations if required and will engage and liaise with other bodies as necessary, such as the local authority Building Control. We will review the Fire Risk Assessment as the alterations are implemented to ensure that all fire safety standards are maintained.

19. Does the Fire and Rescue Service carry out Fire Risk Assessments?

The Fire and Rescue Service do not carry out Fire Risk Assessments for clients, but are one of the enforcing authorities should they become aware that a Fire Risk Assessment is either absent or insufficient. They will carry out programmed visits to premises to inspect Fire Risk Assessments and as such they must be kept available at all times on the premises for inspection. As an enforcing authority the Fire and Rescue Service can:

  • Give advice in either verbal or written form.
  • Issue an Alterations Notice that requires changes to be made to reduce the fire risk.
  • Issue an Enforcement Notice where a responsible person has failed to comply with a provision within the Regulatory Reform (Fire Safety) Order 2005.
  • Serve a Prohibition Notice to stop or restrict the use of all or part of a premises.
  • Initiate prosecution proceedings where there has been a failure to comply with an Enforcement or Prohibition Notice.

20. How long does it take to carry out a Fire Risk Assessment?

This will vary dependent upon the size and nature of the premises and the availability of staff and documentation. A small office premises may take a few hours but a large industrial site may take a number of days.

21. What do I get once the Fire Risk Assessment has been completed?

You will receive a comprehensive report including; the risk assessment documents, detailed analysis, executive summary, recommendations and action plan. You will then receive ongoing support as necessary during the implementation of the action plan. Additionally, support is available to develop relevant policies, procedures and plans that may arise from the Fire Risk Assessment.
